Please read these Terms of Service carefully. By downloading, installing, or using the Calling AI app (the "App"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Social Fabric Digital ("Company," "we," "our," or "us"), governing your access to and use of the Calling AI mobile application and all related services.

By creating an account, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

We reserve the right to modify these Terms at any time. Material changes will be communicated to you through the App. Your continued use of the App following the posting of revised Terms constitutes your acceptance of such changes.

2. Description of Service

Calling AI is a personal growth and goal-setting application that provides daily reflections, astrological insights, AI-powered life coaching, and tools to help you discover your life purpose. The App's features include, but are not limited to: personalized astrological insights based on your birth data; AI-powered coaching through Atlas; goal tracking and milestone management; daily cosmic insights and reflections; the Clarity Map and journaling features; and personalized notifications and reminders.

We reserve the right to modify, suspend, or discontinue any feature of the App at any time, with or without notice.

3. Subscriptions and Payments

Certain features of the App require a paid subscription. By purchasing a subscription, you agree to the following:

Payment is charged to your Apple ID or Google Play account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. The renewal charge will be applied within 24 hours prior to the end of the current period at the rate of your current subscription plan. You can manage and cancel your subscription at any time through your Apple ID account settings or Google Play Store settings.

Prices may change from time to time. If we change the price of a subscription, we will notify you in advance, and the new price will apply to the next billing cycle after the notice. If you do not agree with the price change, you may cancel your subscription before it renews.

4. Account Registration and Security

To access certain features of the App, you must create an account by providing a valid email address and any additional information required during registration.

You agree to provide accurate, current, and complete information during registration and to update such information as necessary to keep it accurate, current, and complete.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate your account at our discretion if we reasonably believe that your account has been compromised or is being used in violation of these Terms.

5. Age Requirement

This App is designed for users aged 16 and older. We do not target, market to, or knowingly collect personal information from anyone under the age of 16. Since the App collects your date of birth for astrological purposes, we use this information to verify that you meet the minimum age requirement. If we determine that a user is under 16, we will promptly delete their account and associated data without notice.

6. User Content and Data

You retain full ownership of all content you create within the App, including but not limited to goals, reflections, journal entries, and Clarity Map data ("User Content").

By using the App, you grant us a limited, non-exclusive, non-transferable license to store, process, and display your User Content solely for the purpose of providing and improving the App's services to you.

We will not use your User Content for advertising purposes, nor will we sell or license your User Content to any third party.

AI Processing: When you interact with Atlas, your conversations and relevant goal data are transmitted to Anthropic's Claude AI for processing. This data is used solely to generate your coaching responses and is subject to Anthropic's data protection obligations under our agreement with them. For more details, please see our Privacy Policy.

7. Prohibited Conduct

You agree that you will not: use the App in violation of any applicable local, state, national, or international law or regulation; create multiple accounts for fraudulent or deceptive purposes; attempt to gain unauthorized access to other users' accounts, data, or any part of our systems; reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App; transmit any viruses, malware, or other harmful code through or to the App; use the App for any commercial purpose without our prior written authorization; impersonate any person or entity or misrepresent your affiliation with any person or entity; or interfere with or disrupt the integrity or performance of the App or its underlying infrastructure.

8. Not a Mental Health Service

This App is for personal reflection, goal-setting, and entertainment purposes only. It is not a substitute for professional mental health care, therapy, counseling, or medical advice.

We are not licensed mental health professionals, therapists, counselors, or medical providers. The content, features, astrological insights, and AI coaching provided in this App should not be used to diagnose, treat, or address any mental health condition.

Astrological insights are for entertainment and reflection purposes only and should not be relied upon for making important life decisions.

By using this App, you acknowledge that you are solely responsible for your own mental health and well-being. We strongly encourage you to seek professional support if you are going through a difficult time.

9. Intellectual Property

The App, including its name, logo, visual design, user interface, underlying code, content, and all associated intellectual property, is owned by Social Fabric Digital and is protected by applicable copyright, trademark, and other intellectual property laws.

These Terms do not grant you any right, title, or interest in the App or our intellectual property, except for the limited right to use the App in accordance with these Terms.

You may not copy, modify, distribute, sell, lease, or create derivative works based on the App or any part thereof without our prior written consent.

10. Account Termination

You may delete your account at any time through the Settings screen within the App. Upon deletion, all of your data will be permanently removed from our servers in accordance with our Privacy Policy.

We may terminate or suspend your access to the App at any time, with or without cause and with or without notice, if we determine in our sole discretion that you have violated these Terms.

Upon termination, your right to use the App will immediately cease. Provisions of these Terms that by their nature should survive termination shall remain in effect, including but not limited to Sections 8, 9, 11, 12, and 13.

11. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

We do not warrant that the App will function uninterrupted, be error-free, or secure; that defects will be corrected; or that astrological insights, AI coaching responses, or any other content will be accurate or reliable.

12. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Social Fabric Digital, its directors, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of or inability to use the App.

This limitation applies to any decisions you make based on content in the App; your mental, emotional, or physical well-being; and any actions you take or do not take as a result of using the App.

In no event shall our total aggregate liability for all claims arising out of or relating to these Terms or your use of the App exceed the greater of (a) the amount you have paid to us in the twelve (12) months preceding the claim, or (b) one hundred dollars ($100.00).

You use this App at your own risk and assume full responsibility for any outcomes.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through the courts of competent jurisdiction located in the State of Maryland.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

15. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Social Fabric Digital with respect to the subject matter hereof and supersede all prior or contemporaneous communications, whether electronic, oral, or written, between you and us regarding the App.
